Public offer

1. General provisions

This document is a public offer of Общество с ограниченной ответственностью «МОМА» (TIN 6671348220, the “Seller”) and contains all essential terms of the retail purchase agreement for the goods presented at https://momamatrix.ru.

The offer is addressed to any legally capable individual (the “Customer”) who places an order on the Site.

Placing an order constitutes full and unconditional acceptance of this offer. From that moment the agreement is deemed concluded on the terms set out herein.

The Seller may amend the offer. An order already placed is governed by the wording in force at the moment it was placed.

2. Subject of the agreement

The Seller undertakes to transfer to the Customer the goods — cosmetic products presented on the Site — and the Customer undertakes to accept and pay for them on the terms of this offer.

The name, composition, volume, price and other characteristics of the goods are stated on the product page. Product images are illustrative; minor differences in packaging shade are not a defect.

3. Placing an order

• The Customer selects the goods and specifies the delivery method, payment method and the contact details required to fulfil the order.
• Each order receives a number the Customer can refer to when contacting the Seller.
• The Seller may decline to fulfil an order if the goods are out of stock or the details provided do not allow delivery. In that case any amount paid is refunded in full.
• An unpaid order is cancelled automatically once the payment waiting period expires.

4. Price and payment

Prices are stated on the Site in Russian roubles. The Seller may change prices unilaterally; the price of an order already placed does not change.

Delivery cost is not included in the price of the goods and is calculated separately at checkout.

Payment methods and the procedure for issuing a fiscal receipt are described in the “Payment” section.

5. Delivery and handover

Delivery terms, cost and coverage are set out in the “Shipping terms” section and form part of this offer.

The Seller’s obligation to hand over the goods is fulfilled when the goods are handed to the Customer or a person designated by them, and for pick-up points — when the goods are released against the order number.

The Customer shall check the completeness and integrity of the packaging upon receipt.

6. Returns and exchange

The Customer’s rights in case of defective goods, the deadlines for claims and the refund procedure are described in the “Return policy” section and form part of this offer.

Refunds are made using the same method as the original payment.

7. Personal data

The Customer’s personal data is processed by the Seller to the extent necessary to fulfil the order, on the terms described in the “Privacy policy” section.

The Seller shares the Customer’s data with delivery services and payment providers solely to the extent required for delivery and payment processing.

8. Liability

The parties bear liability in accordance with the legislation of the Russian Federation.

The Seller is not liable for consequences of using the goods contrary to their purpose, nor for an individual reaction to the ingredients listed on the packaging.

The parties are released from liability in circumstances of force majeure.

9. Dispute resolution

Claims are sent to the Seller at hello@momamatrix.ru. A claim is reviewed within 10 days of receipt.

Disputes not settled through negotiation are resolved in accordance with Russian consumer protection legislation.
